Today a new Spanish gambling regulation has been published, with some measures that come into force immediately.
This new regulation applies to gaming operators, and those natural or legal persons, private or public, who disseminate commercial communications on gaming activities or their operators, through any medium or
support, such as audio-visual or electronic communication service providers, information society service providers, including affiliates, websites and social networks, and any other means of communication.
Therefore, we encourage you to read the new regulations in detail in order to apply them correctly.
How does this affect you as an affiliate partner?
Below we have made a short summary of the changes in the regulation that will affect affiliates:
You must ensure that your website/s or application/s does not promote the gaming activities of entities that are unlicensed in Spain, presenting them as being aimed at Spanish residents.
No acquisition/fidelization promotions can be promoted for Spanish users, from May 1st 2021.
Embedding of demo versions of games is no longer allowed, as they must be available on every operator’s site only after logging in.
When promoting Paf via video platforms, you must observe Section 18, "Commercial communications in audio-visual communication services", regarding hour limitations.
You must ensure that your website/s, application/s and/or accounts or channels in video exchange platforms have mechanisms to prevent the access by minors. Also, you must periodically broadcast messages on safe gaming.
